Key Responsibilities & Facilities:

Tender & Bid Strategy:
- Conducting comprehensive reviews of tender documents to identify key risks, opportunities, and contractual implications.
- Assisting in the preparation of compelling, compliant, and commercially astute bids, including detailed methodologies, robust programmes, and accurate cost submissions.
Contract Review & Negotiation:
- Thorough review of proposed main contracts (e.g., Client’s bespoke terms) and subcontracts.
- Identifying onerous clauses, commercial exposures, and advising on strategic qualifications or amendments.
- Supporting negotiations to secure the most favourable terms and conditions for the contractor.
Operational Project Management Support:
- Developing highly detailed construction phase plans, site-specific methodologies, and efficient logistics strategies.
- Optimising resource allocation (labour, plant, materials) to maximise productivity and minimise waste.
- Implementing Lean Construction principles and other efficiency-enhancing techniques.
Commercial Management & Profitability:
- Rigorous management of project costs, variations, and cash flow to protect and enhance profit margins.
- Preparing and submitting accurate and timely applications for payment, including detailed substantiation.
- Proactive control of procurement costs and strategic management of the supply chain.
Programme Management & Acceleration:
- Developing intricate construction programmes, including critical path analysis and resource loading.
- Continuous monitoring of progress, identifying potential delays, and devising effective programme acceleration or recovery strategies.
Quality Control & Assurance:
- Implementing and monitoring site-specific quality management plans to ensure work meets all specified standards and achieves desired quality outcomes.
- Assisting with internal and external quality audits and certifications.
Facilities for Contract Preparation (Contractor-Side Focus):
- Subcontract Drafting & Management: Expert assistance in drafting robust subcontract agreements that effectively flow down obligations from the main contract while protecting the contractor’s commercial interests.
- Supply Chain Agreements: Preparing and reviewing procurement contracts with key suppliers and vendors.
- Contractual Compliance Advice: Providing ongoing advice and training to project teams on contractual obligations, notice periods, and proactive compliance to minimise claims against the contractor.
- Risk Allocation Optimisation: Advising on strategies to transfer or mitigate risks through subcontract terms.
Dispute Management (Contractor-Side Focus):
- Proactive Claims Identification: Assisting in the early identification and notification of potential claims for extensions of time, loss and expense, or variations, ensuring all contractual conditions precedent are met.
- Robust Claims Preparation: Expertise in compiling, substantiating, and presenting comprehensive claims with clear contractual arguments and meticulous supporting documentation (programmes, cost records, correspondence).
- Contractual Entitlement Advice: Providing clear guidance on the contractor’s rights and entitlements under the contract, helping to navigate complex contractual provisions.
- Negotiation & Resolution Support: Representing or supporting the contractor during negotiations, mediations, or formal dispute resolution processes (e.g., Adjudication, Arbitration) to secure fair and commercially advantageous outcomes.
- Defence Against Counterclaims: Assisting in the robust defence against counterclaims or liquidated damages levied by the client.
- Record Keeping for Defence: Advising on and implementing best practices for contemporaneous record-keeping to provide irrefutable evidence in the event of a dispute.
